Welcome to Photosynthesis Photography Services (“Photosynthesis”, “we”, “our”, or “us”).
These Terms & Policies govern all photography and cinematography services provided by Photosynthesis Photography Services and apply to every quotation, invoice, booking confirmation, agreement, and service offered by us.
By requesting a quotation, confirming a booking, paying a booking advance, making any payment towards our services, or otherwise engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Policies.
These Terms & Policies form an integral part of every booking unless otherwise agreed in writing.
If any provision of these Terms & Policies is held to be invalid or unenforceable under applicable law, the remaining provisions shall continue to remain valid and enforceable.
1. Booking Confirmation
A booking is confirmed only upon receipt of the agreed booking advance.
Until the booking advance is received, all dates remain tentative and may be released without prior notice. Photosynthesis Photography Services reserves the right to accept another booking for the same date(s) until the booking is confirmed.
Upon confirmation, the requested date(s) are reserved exclusively for the Client. As a result, we may decline or become unavailable for other enquiries relating to those dates.
A confirmed booking constitutes acceptance of these Terms & Policies.
2. Payment Terms
The applicable package price, payment schedule and due dates shall be specified in the quotation or invoice issued to the Client.
Unless otherwise agreed in writing:
- The booking advance shall be payable at the time of confirmation.
- The remaining balance shall be payable in accordance with the payment schedule mentioned in the quotation.
- Deliverables may be withheld until all outstanding payments have been received.
Payments may be made through the payment methods communicated by Photosynthesis Photography Services.
All payments shall be acknowledged by an official receipt or payment confirmation.
Delayed payments may result in delays in delivery of photographs, films, albums or other deliverables.
3. Booking, Cancellation & Rescheduling
The booking advance is paid to reserve the agreed event date(s). Upon confirmation, Photosynthesis Photography Services commits its schedule exclusively to the Client and may decline other enquiries for the same date(s).
Accordingly, the booking advance is non-refundable.
This policy reflects the business costs associated with reserving dates, allocating resources, planning the assignment, and the loss of alternative booking opportunities.
If the Client chooses to cancel the booking, the booking advance shall ordinarily not be refunded.
However, at the sole discretion of Photosynthesis Photography Services, the booking advance may be adjusted as a credit towards another photography or cinematography booking within twelve (12) months from the original event date, subject to availability.
The booking credit:
- is non-transferable;
- cannot be exchanged for cash;
- may be used only by the original Client; and
- shall lapse if not utilised within the specified period.
Rescheduling
Requests to reschedule an event shall be considered subject to availability.
If Photosynthesis Photography Services is available on the revised date, the booking advance shall be transferred to the new booking.
If the requested date is unavailable, the booking shall be treated as a cancellation under this Policy.
4. Refund Policy
Except as expressly stated in these Terms & Policies or where required under applicable law, payments made towards the Services are non-refundable.
The booking advance is paid to secure the event date(s) and compensate for the reservation of our time, planning, scheduling, and the commitment of resources. Accordingly, the booking advance is non-refundable.
Where a booking is cancelled by the Client, any adjustment of the booking advance as a future booking credit shall be governed by Section 3 (Booking, Cancellation & Rescheduling).
If Photosynthesis Photography Services is unable to perform the contracted Services due to reasons within our reasonable control, any amounts received for the affected Services shall be refunded to the Client. Such refund shall constitute the Client’s sole remedy, and our liability shall not exceed the amount actually paid by the Client.
Refunds, where applicable, shall be processed using the original mode of payment or any other mutually agreed method within a reasonable period.
5. Service Delivery
Photosynthesis Photography Services shall make every reasonable effort to deliver photographs, films, albums and other deliverables within the estimated timelines communicated to the Client.
Delivery timelines are estimates only and may vary depending on factors including, but not limited to:
- Number of events covered.
- Volume of photographs and video footage.
- Album design approvals.
- Client response times.
- Seasonal workload.
- Technical requirements.
- Circumstances beyond our reasonable control.
Reasonable delays shall not constitute a breach of these Terms & Policies.
Digital deliverables shall ordinarily be supplied through online galleries, cloud storage, downloadable links, or other suitable electronic means.
Physical products, including albums, prints and framed artwork, shall be delivered after completion of production by our manufacturing partners.
The Client is responsible for reviewing and approving album designs within a reasonable time. Delays in approval may result in corresponding delays in production and delivery.
6. Image Selection & Editing
The artistic style, editing approach, colour grading, cropping, sequencing and final presentation of all photographs and films shall remain at the sole professional discretion of Photosynthesis Photography Services.
The Client acknowledges that photography and cinematography are creative services involving artistic interpretation.
Unless specifically agreed in writing, RAW files, unedited photographs, unedited video footage, project files and working files shall remain the exclusive property of Photosynthesis Photography Services and shall not form part of the deliverables.
Minor variations in colour, exposure and appearance may occur due to differences in display devices, print media and viewing conditions and shall not constitute a defect in the Services.
7. Copyright & Intellectual Property
Unless otherwise agreed in writing, all photographs, films, albums, edited images, video edits, designs, graphics, and other creative works produced by Photosynthesis Photography Services shall remain the intellectual property of Photosynthesis Photography Services and shall be protected under the Copyright Act, 1957 and other applicable laws of India.
Upon full payment of all applicable fees, the Client is granted a non-exclusive, non-transferable licence to use the delivered photographs and films for personal, non-commercial purposes.
The Client shall not:
- Sell or commercially exploit the photographs or films.
- Edit, alter, apply filters, or substantially modify the delivered work.
- Remove watermarks or copyright notices, where applicable.
- Submit the work for competitions, publications, advertising, or commercial use without prior written consent.
Any commercial use requires prior written permission from Photosynthesis Photography Services.
8. Portfolio & Promotional Use
Photosynthesis Photography Services reserves the right to use selected photographs and films from the event for its portfolio, website, blog, social media platforms, exhibitions, competitions, advertising, promotional materials, and other lawful business purposes.
If the Client requires complete confidentiality or wishes to restrict such usage, the same must be requested in writing before the booking is confirmed. Any such restriction shall become effective only if expressly accepted by Photosynthesis Photography Services in writing.
We respect our Clients’ privacy and will make reasonable efforts to honour mutually agreed confidentiality arrangements.
9. Client Responsibilities
The Client agrees to:
- Provide accurate event details and schedules.
- Inform us of any changes to the event itinerary without undue delay.
- Obtain all permissions required from venues, organisers, religious institutions, or other authorities for photography and videography.
- Ensure reasonable access to all locations necessary for providing the Services.
- Inform us in advance of any venue restrictions relating to photography, videography, drones, flash, lighting, or equipment.
Photosynthesis Photography Services shall not be responsible for missed photographs or delayed coverage arising from:
- Late arrival of the Client or guests.
- Changes to the event schedule not communicated in advance.
- Restrictions imposed by the venue or organisers.
- Weather conditions affecting outdoor events.
- Instructions from the Client, family members, event planners, priests, or venue management that limit or prevent coverage.
The Client acknowledges that the quality and completeness of coverage may be affected by circumstances beyond our reasonable control.
10. Meals & Working Conditions
For bookings involving continuous coverage exceeding six (6) hours, the Client shall arrange reasonable meals and drinking water for the photography and cinematography team during appropriate breaks.
Where coverage extends late into the night or across multiple days, reasonable arrangements for rest, access, and accommodation (where agreed in the quotation) shall be provided by the Client.
Photosynthesis Photography Services reserves the right to take reasonable meal and rest breaks without materially affecting event coverage.
11. Equipment, Backup & Data Protection
Photosynthesis Photography Services maintains professional equipment and follows reasonable backup practices to safeguard photographs and video footage.
While every reasonable effort is made to protect the Client’s photographs and films, unforeseen circumstances beyond our reasonable control, including equipment malfunction, data corruption, storage failure, theft, fire, natural disasters, or other technical failures, may result in partial or complete loss of data.
In the unlikely event of such loss, our liability shall be limited in accordance with Section 13 (Limitation of Liability).
The Client acknowledges that photography and cinematography involve the creation and storage of digital data, and absolute protection against all forms of data loss cannot be guaranteed.
12. Image Storage & Archiving
Photosynthesis Photography Services will make reasonable efforts to retain the Client’s edited photographs and films for a period of twelve (12) months from the date of final delivery.
After this period, files may be permanently deleted without further notice.
Clients are strongly advised to download, back up, and securely store all delivered photographs, films, and other digital deliverables upon receipt.
Photosynthesis Photography Services shall not be responsible for recovering or reproducing files that have been deleted after the retention period.
13. Limitation of Liability
Photosynthesis Photography Services shall perform the Services with reasonable skill, care, and professional diligence.
To the fullest extent permitted by applicable law, Photosynthesis Photography Services shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive loss or damage, including loss of profits, business opportunities, emotional distress, or third-party claims arising from or relating to the Services.
In any event, the total liability of Photosynthesis Photography Services, whether arising in contract, tort, negligence, or otherwise, shall not exceed the total amount actually paid by the Client for the affected Services.
Nothing in these Terms & Policies shall exclude or limit liability where such exclusion is prohibited by applicable law.
14. Force Majeure
Neither the Client nor Photosynthesis Photography Services shall be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond reasonable control.
Such events include, but are not limited to:
- Natural disasters
- Floods
- Fire
- Earthquakes
- Government restrictions
- War
- Civil unrest
- Epidemics or pandemics
- Transport disruptions
- Venue closures
- Power failures
- Any other unforeseen event beyond reasonable control
Where reasonably possible, both parties shall cooperate in good faith to reschedule the Services.
15. Privacy
Photosynthesis Photography Services collects only such personal information as is reasonably necessary to respond to enquiries, process bookings, communicate with Clients, deliver Services, and comply with applicable legal obligations.
We do not sell, rent, or trade personal information to third parties.
Personal information may be shared only with trusted service providers engaged for the purpose of delivering our Services or where disclosure is required by law.
Reasonable technical and organisational measures are adopted to protect personal information. However, no method of electronic transmission or storage can be guaranteed to be completely secure.
16. Governing Law & Jurisdiction
These Terms & Policies shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or relating to these Terms & Policies or the Services provided by Photosynthesis Photography Services shall, subject to applicable law, be subject to the exclusive jurisdiction of the competent courts at Faridabad, Haryana.
17. Changes to these Terms & Policies
Photosynthesis Photography Services reserves the right to update or modify these Terms & Policies from time to time.
The latest version published on our website shall apply to future bookings. Changes shall not affect bookings already confirmed unless mutually agreed in writing.
